Chongqing Issues the Chongqing Data Regulations

On March 30, 2022, Chongqing issued the "Chongqing Data Regulations" (“Regulations”). It will come into force on July 1, 2022.

1. Establishing data security system. The regulations are clear and establish a data classification and grading protection system and data security risk assessment, reporting, information sharing, monitoring and early warning, and emergency response mechanisms. Handling data involving personal information, relevant principles and other rules shall be followed, a system of complaints and reporting shall be established, and channels for the protection of personal information shall be unblocked.

2. Carrying out cross-border flow of data. The regulations propose to support the cross-border flow of data, and rely on China-Singapore (Chongqing) and other dedicated international Internet data channels to promote the construction of an international data port. At the same time, jointly build a data standardization system in the Sichuan-Chongqing region, and jointly establish basic data standards and specifications in accordance with the needs of regional data sharing to promote the sharing and utilization of data resources.

3. Strengthening the supervision and management of online transactions. In addition to regulating the data use behaviors of market entities, the regulations also stipulate that violating the open utilization agreement signed with the municipal data authority, the use of public data beyond the agreed range will be fined up to RMB 100,000.
